These Terms of Service ("Terms") govern your use of the Sayda mobile application (the "App"), a tool for practicing English pronunciation through AI-generated conversations. By using the App, you agree to these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using the App, you confirm that you accept these Terms and agree to comply with them. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. By using Sayda, you represent that you meet this requirement.
3. The Service
Sayda lets you practice pronunciation by listening to AI-generated reference audio, recording yourself, and receiving automated pronunciation scores and AI coaching feedback. Features may change, be added, or be removed over time. We may modify or discontinue any part of the App at any time.
4. Your Account
- You sign in using a third-party provider (Google or Apple) and are responsible for maintaining the security of that account.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate information and to notify us of any unauthorized use of your account.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws.
- Upload audio or content that is illegal, abusive, infringing, or that violates the rights of others.
- Attempt to reverse-engineer, decompile, disrupt, overload, or gain unauthorized access to the App or its servers.
- Use automated systems to access the App in a manner that sends more requests than a human could reasonably produce.
- Resell, sublicense, or commercially exploit the App without our permission.
6. User Content
"User Content" includes the voice recordings and practice text you submit. You retain ownership of your User Content. You grant Sayda a limited, non-exclusive license to process, store, and transmit your User Content solely to operate and provide the App's features to you (for example, sending recordings for pronunciation scoring). We do not use your recordings for advertising.
7. AI-Generated Content
The App uses artificial intelligence to generate conversations, reference audio, and feedback. AI output may be inaccurate, incomplete, or unsuitable in some cases. Sayda is intended for language-learning practice only and does not guarantee any specific learning outcome. You should use your own judgment when relying on AI-generated content.
8. Intellectual Property
The App, including its design, text, graphics, logos, and software (excluding your User Content and third-party materials), is owned by Sayda and protected by intellectual property laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use the App for your own personal, non-commercial use.
9. Third-Party Services
The App relies on third-party services (including Google, Apple, Microsoft Azure, and AI/speech and storage providers) to function. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the practices of third-party services.
10. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, Sayda and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of (or inability to use) the App.
12. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the App or other users. Upon termination, the licenses granted to you under these Terms will end.
13. Changes to These Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, notify you within the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-law provisions. Any disputes shall be subject to the competent courts located in Vietnam, unless otherwise required by applicable mandatory law.
